Request approval of a contract between Fulton County and the Atlanta Association for Convalescent Aged Persons, Inc., a Georgia non-profit corporation, to provide funding of $1,200,000.00 as non-recurring for FY2023 for the operation of Sadie G. Mays Health and Rehabilitation Center. Effective upon BOC approval with automatic renewals subject to the appropriation of future funding. The County Attorney is authorized to approve the contract as to form and to make modifications thereto prior to execution. (APPROVED UPON ADOPTION OF THE CONSENT AGENDA)

Pursuant to O.C.G.A. § 36-1-19.1 Counties are authorized to appropriate money for and make grants or contributions to any corporation, association, institution, or individual for purely charitable purposes, provided that the activities funded by any such grants or contributions shall take place within the county making such grant or contribution. Pursuant to O.C.G.A. § 36-10-1, all contracts entered into by the county governing authority with other persons on behalf of the county shall be in writing and entered on its minutes.

On June 19, 1968, Fulton County entered into an agreement (1968 Agreement) with the Atlanta Association for Convalescent Aged Persons, Inc. (the “Association”) to provide financial support for the operation of the Sadie G. Mays Health & Rehabilitation Center. Since that time, the Association has been receiving funds monthly from Fulton County in support of providing care for the ill and indigent elderly citizens of Fulton County at the Sadie G. Mays facility. On January 18, 2023, the Fulton County Board of Commissioners approved a $1,200,000.00 in the FY2023 Budget, as non-recurring, to provide financial assistance for FY2023 to the Association for operation of the Sadie G. Mays. This contract memorializes the terms of that $1,200,000 appropriation. This Contract restates and replaces the terms of the 1968 Agreement as same is amended and updated by this Contract. Future payments or subsidization shall be negotiated and mutually agreed upon, based on actual cost per patient and subject to the appropriation of future funding.
Scope of Work: The Association will provide vital care to the ill, indigent elderly citizens of Fulton County who reside at the Sadie G. Mays Facility, now and in the future
Community Impact: The ill, indigent elderly citizens of Fulton County will benefit from the care provided by the Sadie G. Mays Facility.
Department Recommendation: The Department recommends approval of the Contract.
