Georgia Const. Art. 9, § 3, ¶ I, provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. Further, O.C.G.A § 36-10-1 provides that “[a]ll official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.”

Summary & Background:

 

Scope of Work: The Georgia Department of Transportation (GDOT) is planning to resurface Roswell Road (State Route 9) from Meadowbrook Drive to Abernathy Road in Sandy Springs. As part of this project, 58 sanitary sewer manholes and associated appurtenances located within the existing Fulton County-owned sewer line right-of-way will need to be adjusted to the proposed grade. GDOT plans to bid the project by the end of 2026 and has requested execution of a Contract Item Agreement (CIA) with Fulton County. This agreement will allow GDOT to include the sewer manhole adjustments in their bid package. Fulton County will reimburse GDOT for the actual cost of the utility relocation work upon completion and acceptance of the bid. Sewer service is expected to remain largely uninterrupted during the construction period. Fulton County staff will be on-site during the sewer manhole adjustments to ensure the work is completed in accordance with County standards. The estimated cost for the relocation and installation of the impacted sewer infrastructure is $174,000.00, which has been budgeted through the Water & Sewer Fund and included in the 2026-2030 Capital Improvement Program.

 

Community Impact: The existing 8inch sewer line serves various facilities along resurfacing Roswell Road (State Route 9) within Sandy Springs. The planned roadway resurfacing will impact several sewer manholes that provide critical service to developments in the area. Adjustment of these manholes is necessary to ensure uninterrupted service and to accommodate GDOT’s construction activities.

 

Department Recommendation: The Department of Public Works believes the most cost-effective approach to completing the sewer manhole adjustments is to allow the Georgia Department of Transportation (GDOT) to include the work in their roadway project bid. Therefore, the Department recommends that Fulton County enter into a Contract Item Agreement (CIA) with GDOT.

 

Project Implications: The roadway resurfacing along resurface Roswell Road (State Route 9) will impact existing sewer manholes due to necessary storm structure modifications and changes in roadway grades. As a result, the sewer manholes must be adjusted to match the proposed roadway elevations. These adjustments are essential to maintaining sewer service in the area.

 

Community Issues/Concerns: Sewer service will be maintained throughout the construction period. However, temporary service interruptions may occur during the work. Impacted customers will be notified in advance.

 

Department Issues/Concerns: The Department of Public Works is not aware of any issues or concerns with the proposed CIA. Similar agreements between GDOT and Fulton County have proven effective on past projects.
