GA CONST Art, 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. O.C.G.A § 36-10-1 provides that all official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Summary & Background

In 1956, an IGA with the City of Roswell, and its subsequent amendments, established coordination between the County and the City of Roswell with the City of Roswell acting as a sewer billing collection agent. Recently, the City of Roswell expressed the need to install an additional interconnection between their water distribution system and Fulton County’s water distribution system. This desire brought to light the age and outdated nature of the existing IGA, and so the proposed IGA was developed to better codify the ongoing coordination between the two parties.

 

Scope of Work: This IGA consists of two major parts:
1) Interconnections between the two water distribution systems
The IGA establishes procedures for how interconnections are requested and approved, as well as the procedures for opening existing interconnection to allow water to flow from Fulton to Roswell, including notification responsibilities for emergency conditions.

2) City of Roswell water service area sewer billing
The IGA continues the longstanding agreement whereby the City of Roswell acts as Fulton County’s sewer billing collection agent in an area of Fulton County where the City of Roswell is the water provider.

 

Community Impact: The City of Roswell serves a portion of Fulton County via their water distribution system and bills Fulton County sewer customers within their water service area on Fulton’s behalf. This new IGA would allow Fulton County and the City of Roswell to continue to work together to provide water and sewer service to Fulton County residents, no matter their water provider, in an efficient and sensible manner.

 

Department Recommendation: The Public Works Department recommends approval of this item.

 

Project Implications: This agreement is necessary for the two entities to continue cooperating to deliver safe and clean drinking water as well as the safe collection, transport, and treatment of wastewater.

 

Community Issues/Concerns: No community issues have been brought to the Department’s attention at this time.
