Requirement for Board Action
Pursuant to O.C.G.A. § 36-9-2, Fulton County is permitted, by order entered on its minutes, to direct the disposal of any real property which may lawfully be disposed of and make and execute good and sufficient title thereof on behalf of the county.

Summary & Background
Scope of Work: Fulton County (“County”) acquired a stormwater drainage easement in or around February 1984 located in the area of Wing Mill Road, as depicted in the Final Subdivision Plat for Grogan’s Bluff (recorded at Plat Book 139, Page 105, Fulton County, Georgia records). The easement was originally established to maintain a drainage system servicing the Grogan’s Bluff housing development, which was located in unincorporated Fulton County at the time but is now within the jurisdictional limits of the City of Sandy Springs, Georgia (“Sandy Springs”).
The Sandy Springs Public Works Department recently received notice of accumulated siltation on private property caused by blockages in the drainage system covered by the easement and requires access to the area to perform necessary repairs. Because Fulton County is no longer responsible for managing stormwater within Sandy Springs' jurisdictional limits, the County has no further need for the easement.
In accordance with County Policy, approval of the Fulton County Board of Commissioners is required to assign the stormwater drainage easement to Sandy Springs to grant them full access and authority to maintain, repair, and manage the drainage infrastructure within the easement area.
Community Impact: Approval of this assignment transfers stormwater drainage maintenance authority to the City of Sandy Springs, enabling their Public Works Department to access the easement, clear blockages, and remediate accumulated siltation on adjacent private property. Project Implications: The proposed assignment transfers ownership and operational responsibility of the Wing Mill Road stormwater easement to the City of Sandy Springs, eliminating any allegedly ongoing maintenance liability on behalf of the County and allowing the City to directly address drainage system blockages and siltation issues within its jurisdictional boundaries governing the property at 235 Wing Mill Road, Sandy Springs, GA (Parcel ID: 17 002900020165).
