GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. Further, O.C.G.A § 36-10-1 provides that “[a]ll official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.”

Scope of Work: The Georgia Department of Transportation (GDOT) is currently planning to widen Fulton Industrial Boulevard at Bucknell Drive and construct sidewalk improvements. As part of this effort, approximately 71 linear feet of 8-inch sewer line,  Fulton County-owned sewer lines, along with associated appurtenances, will be relocated within the existing right-of-way. GDOT plans to bid on the project by the end of 2026 and has requested execution of a Contract Item Agreement (CIA) with Fulton County. This agreement will allow GDOT to include the sewer line relocation in their bid package. Fulton County will reimburse GDOT for the actual cost of the utility relocation work upon completion and acceptance of the bid.  Sewer service is expected to remain largely uninterrupted during the construction period. Fulton County staff will be on-site during the relocation of the sewer lines to ensure the work is completed in accordance with Fulton County standards. The estimated cost for the relocation and installation of the impacted sewer lines is $54,350.00, which has been budgeted through the Water & Sewer Fund and included in the 2026-2030 Capital Improvement Program. 

 

Community Impact: The existing 8-inch sewer line currently serves various facilities along Fulton Industrial Boulevard within Fulton County. The planned roadway improvements will impact these sewer lines, which provide critical service to developments in the area. Relocation is necessary to ensure uninterrupted service and to accommodate GDOT’s construction activities.

 

Department Recommendation: The Department of Public Works believes the most cost-effective approach to completing the sewer line relocations is to allow the Georgia Department of Transportation (GDOT) to include the work in their roadway project bid. Therefore, the Department recommends that Fulton County enter into a Contract Item Agreement (CIA) with GDOT.

 

Project Implications: The roadway widening along Fulton Industrial Boulevard will impact existing sewer lines due to necessary storm structure modifications and changes in roadway grades. As a result, the sewer lines must be relocated and manholes adjusted to match the proposed roadway elevations. These relocations are essential to maintaining continuous sewer service in the area.

 

Community Issues/Concerns: Sewer service will be maintained throughout the construction period. However, temporary service interruptions may occur during construction between the new and existing sewer lines. Impacted customers will be notified in advance.

 

Department Issues/Concerns: The Department of Public Works is not aware of any issues or concerns with the proposed CIA. Similar agreements between GDOT and Fulton County have proven effective on past projects.
