Pursuant to O.C.G.A. § 36-60-13, each county or municipality in this state shall be authorized to enter into multiyear lease, purchase, or lease purchase contracts of all kinds for the acquisition of goods materials, real and personal property, services and supplies and O.C.G.A. § 36-10-1, all contracts entered into by the county governing authority with other persons on behalf of the county shall be in writing and entered on its minutes.

Scope of Work: The approval of the Fulton County Board of Commissioners is being requested to extend the lease term at the 5500-B Fulton Industrial Boulevard for an additional seven (7) years. The current lease agreement for 24,798 square feet of warehouse and office space that is required for the operations of the Fulton County District Attorney at 5500-B Fulton Industrial Boulevard was approved as Agenda Item #13-0406 at the Board of Commissioners’ Meeting held June 19, 2013.

 

The First Extended Initial Term of the First Amendment and Extension to Lease Agreement shall be from January 1, 2024, through December 31, 2024, with six (6) automatically renewing Extended Option Terms. Each Extended Option Term shall begin on January 1st, and end on December 31st and shall be subject to appropriation of funds by the Board of Commissioners pursuant to O.C.G.A. § 36-60-13.

 

Community Impact: The District Attorney’s continued use of warehouse and office space at this leased location is necessary to secure evidence for effective prosecution of criminal acts committed within the limits of Fulton County.

 

Department Recommendation: The Department of Real Estate and Asset Management recommends approval of a First Amendment and Extension to Lease Agreement for the purpose of amending certain provisions of the current lease agreement and extending the lease term at 5500-B Fulton Industrial Boulevard, Atlanta, Georgia 30336, for the operations of the Fulton County District Attorney. 

 

Project Implications: Extension of the current lease agreement is necessary to formalize the terms of continued occupancy for the District Attorney’s staff.

History of BOC Agenda Item:   The initial lease agreement for this location was approved as Agenda Item #13-0406 at the Board of Commissioners Meeting held June 19, 2013.
