GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. O.C.G.A § 36-10-1 provides that all official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Scope of Work: The City of Milton is currently planning the Birmingham Road Culvert Bridge Replacement Project near Manor Trace, which includes road widening and the replacement of the existing culvert bridge. As part of this roadway project, approximately 150 linear feet of 12-inch water main, along with associated appurtenances, will need to be relocated within the existing right-of-way. Water service will remain uninterrupted throughout the construction period. The City of Milton bid the Culvert Bridge Replacement Project in June 2025 and is now requesting the execution of an Intergovernmental Agreement (IGA) with Fulton County. This agreement would allow the City to include the water main relocation as part of its project. Upon completion of the relocation work by the City’s contractor, Fulton County will reimburse the City of Milton for the associated costs. Fulton County staff will be present during the water main relocation to ensure that the construction meets County standards. The total estimated cost for the relocation and installation of the affected water mains is $206,400.00. This amount has been budgeted under the Water and Sewer Fund and is included in the County’s 2016-2026 Capital Improvement Program.
Community Impact: Currently, Fulton County operates a 12-inch water main that serves properties along this section of Birmingham Road. The Culvert Bridge replacement will impact the existing water lines that serve developments in the area, as well as the broader distribution system within the City of Milton. During construction, there will be isolated water outages as services are disconnected from the existing main and reconnected to the new main.
Department Recommendation: The Department of Public Works believes the most cost-effective approach to completing the water main relocations is to allow the City of Milton to include the work in its bid for the Culvert Bridge Replacement Project. Therefore, the Department recommends that Fulton County enter into an Intergovernmental Agreement (IGA) with the City of Milton.
Project Implications: The Culvert Bridge replacement along Birmingham Road will impact the existing water mains due to grade modifications that will require the relocation of the water main and adjustment of valves to match the proposed roadway surface. These relocations are necessary to maintain uninterrupted water service in the area.
Community Issues/Concerns: During the relocations, water service will be maintained although temporary interruptions may occur during tie-ins with the existing water main.
Department Issues/Concerns: The Public Works Department is not aware of any issues or concerns with this proposed Intergovernmental Agreement (IGA). This type of arrangement between the City of Milton and Fulton County has worked well on past projects.
