Pursuant to GA CONST Art. 9, § 3, ¶ I, a county may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services. Further, O.C.G.A. § 36-10-1 provides that all official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Summary & Background: Department of Public Works request approval of an Intergovernmental Agreement between Forsyth County, the City of Milton, and Fulton County for the provision of water services to certain property located within the City of Milton to be served water service by Forsyth County.
Scope of Work: This agreement will allow for Forsyth County to provide water service to a portion of a residential development located within the North Fulton County water system area. Access to this portion of the development will be from Forsyth County. The capital/construction cost of Fulton County providing water service to this development along public right of way would add about $50,000.00 to the cost of each of the residential lots within Fulton County / City of Milton and would duplicate water service available from Forsyth County that can be provided without the added cost. Fulton County has similar reciprocal projects where Fulton County provides water service to portions of development in Forsyth County. Sewer service for the lots in Fulton County / City of Milton will be provided by septic tank.
This Intergovernmental Agreement between the City of Milton, Forsyth County, and Fulton County defines performance responsibilities of the parties until December 31, 2072 unless the IGA is terminated by either party.
Community Impact: This agreement will allow the portion of the residential subdivision within Fulton County and the City of Milton to be developed with a public water system.
Department Recommendation: The Department of Public Works recommends approval of the Intergovernmental Agreement with the City of Milton and Forsyth County.
Project Implications: Failure to implement this agreement will inhibit service to the portion of the Puckett Assemblage Development in Fulton County.
