Pursuant to Fulton County Code § 1-117, which provides that the Board of Commissioners “shall have exclusive jurisdiction and control over . . . directing and controlling all the property of the county ...” and O.C.G.A. §36-9-2, which provides that the “county governing authority shall have the control of all property belonging to the county and may, by order entered on its minutes, direct the disposal of any real property which may lawfully be disposed of and make and execute good and sufficient title thereof on behalf of the county.”

Scope of Work: The Department of Real Estate and Asset Management (“DREAM”) received a formal request to acquire easement rights for 145 square feet of County-owned real property at 860 Marietta Boulevard, Atlanta, Georgia from the Atlanta Development Authority d/b/a Invest Atlanta by and through its designated special agent, Atlanta Beltline, Inc. to facilitate the construction and maintenance of their Westside Trail Extension Project.   Prior to the conveyance of real property rights in properties owned by Fulton County, DREAM staff completed an assessment of the subject real property and concluded that the conveyance of the requested easement rights will not impact its operational needs of the County. In exchange for the easements rights that will be conveyed, Fulton County will received the fair market value of $1,269.00, which has been determined by an independent and licensed real estate appraiser. In accordance with County Policy the approval of the Fulton County Board of Commissioners is required prior to the conveyance of real property rights.                                                       

 

 

 

Community Impact: The Atlanta Beltline is in the process of acquiring real property rights for the purpose of extending the Atlanta Beltline corridor in northwest Atlanta.  Acquisition of the subject easement will contribute to the overall objective of the Beltline Project, to implement a comprehensive transportation and economic development project for the general public in the City of Atlanta that connects in town neighborhoods, contributes to the quality of life, creates jobs, and stimulates development and economic growth. 

 

Department Recommendation: The Department of Real Estate and Asset Management recommends approval of the grant of a 145 square foot permanent construction and maintenance easement in property owned by Fulton County at 860 Marietta Boulevard, Atlanta, Georgia to the Atlanta Development Authority, d/b/a Invest Atlanta through Atlanta Beltline, Inc., its designated special agent.
