Scope of Work:
At the December 19, 2018 Board of Commissioner meeting, the BOC approved a resolution and Memorandum of Understanding (BOC Agenda #18-0921) between Fulton County and the City of South Fulton to transfer funds collected under the TSPLOST I program, which was in place from April 1, 2017 through March 31, 2022.  When the TSPLOST program was initiated, the area that is now part of the City of South Fulton was still a part of unincorporated Fulton County.  Therefore, the TSPLOST program was initially set up for Fulton County to collect the funds for this area.

At that time, the Fulton Industrial District was still a part of unincorporated Fulton County, therefore the Fulton Industrial Boulevard at Cascade Road intersection project remained part of Fulton County and the funds ($900,000.00) associated with that project were not transferred to the City of South Fulton.  As part of HB445, the 2021 Georgia General Assembly allowed the Fulton Industrial District area, south of I-20, to be annexed into the City of South Fulton.  Therefore, the intersection project at Fulton Industrial Boulevard at Cascade Road became a City of South Fulton project and no longer under the control of Fulton County.

Over the past few years, the City of South Fulton has been working with GDOT on the design of the improvements that would be constructed at this intersection.  The project is now planned for construction within the next year and the City of South Fulton has requested that Fulton County transfer the $900,000.00 collected in TSPLOST funds to them for use on this intersection project.

 

Community Impact:
No community impact is expected since the City of South Fulton is required to utilize these funds for the project identified in the TSPLOST program under the MOU and the TSPLOST statute, O.C.G.A. § 48-8-265.

 

Department Recommendation:
The Department of Public Works recommends approval of the resolution and execution of the amendment.  The Department further supports the transfer of the funds to the City of South Fulton.

 

Project Implications:
This amendment of the MOU will allow the City of South Fulton to manage and pay for the TSPLOST project without Fulton County's oversight. This is the same arrangement that all other municipalities have with Fulton County in how they manage their TSPLOST programs.

 

Community Issues/Concerns:
No community issues or concerns have been expressed to Public Works.

 

Department Issues/Concerns:
Public Works has no concerns with the MOU.
