Request approval of a Resolution approving the transfer of three (3) Right of Way Deeds between Fulton County, Georgia (Grantor) and the Georgia Department of Transportation (GDOT) (Grantee) for Fulton County-owned property located at 0 Delmar Lane NW, Atlanta, Georgia and 0 Oakcliff Road NW, Atlanta, Georgia to construct roadway improvements; authorizing the Chairman to execute the Right of Way Deeds and related documents; authorizing the County Attorney to approve the Right of Way Deeds and related documents as to form and to make necessary modifications thereto prior to execution; and for other purposes. Requirement for Board Action
O.C.G.A. § 36-9-2 authorizes Fulton County to sell, grant, lease, rent, convey, or transfer any real property owned by the County and Fulton County Code § 1-117 provides that the Board of Commissioners has exclusive jurisdiction and control over all property of the County. O.C.G.A. § 36-9-3(a)(2)(A) authorizes Fulton County to grant rights of ways without a competitive process.

Summary & Background The Department of Real Estate and Asset Management - DREAM received offers from the Georgia Department of Transportation (“GDOT”) to acquire the following within County-owned real property: approximately 4567.88 square feet of right of way, 263.26 linear feet of access, and 0.038 acres for a temporary driveway easement at 0 Delmar Lane NW, Atlanta, Georgia (Tax Parcel ID # 14 0238 LL0337); approximately 2,946.13 square feet of real property from 0 Oakcliff Road NW #Rear, Atlanta, Georgia (Tax Parcel ID # 14 023800040357); and approximately 20,571.21 square feet of right of way and 68.99 linear feet of access from 0 Oakcliff Road NW #Rear, Atlanta, Georgia (Tax Parcel ID # 14 023800040373).
GDOT requires the aforementioned property rights to construct the I-285 / I-20 Interchange Improvement Project, PROJECT NO. 0013918, which will improve traffic flow and travel safety, and reduce air pollution caused by vehicular emissions.
Market value assessments determined the fair market values of the right of way areas to be $500.00, $7,500.00, and $27,500.00, respectively.
The approval of the Fulton County Board of Commissioners is required prior to the transfer of real property rights to GDOT.
Community Impact: Approval of the right of way deeds with the Georgia Department of Transportation will not adversely impact the residents of the community where the subject real properties are located, and the proposed construction is being completed to improve traffic conditions for residents and visitors to Fulton County.
Department Recommendation: The Department of Real Estate and Asset Management recommends approval of the Resolution to convey the requested real property rights to the Georgia Department of Transportation to improve public travel safety.
Project Implications: The planned construction of the I-285 / I-20 Interchange Improvement Project at the interchange from I-285 to I-20 West is expected to reduce traffic congestion, enhance roadway connectivity, and improve travel safety.

The funds received ($35,500.00) from the sale of the requested right of way and easement areas will be deposited into the General Fund
