GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. In addition, O.C.G.A § 36-10-1 states that all official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Summary & Background:
Scope of Work: The City of Milton bid the Crabapple Road and Green Road Improvement Project at the beginning of 2026, and the project has since been completed. The work included road widening and the replacement of existing roadway sections. As part of the project, approximately 922 linear feet of 8‑inch water main, along with associated appurtenances, were relocated within the existing right‑of‑way. Water service remained uninterrupted throughout the construction period, and Fulton County staff were present during construction to ensure that all work met County standards. The City is now requesting execution of an Intergovernmental Agreement (IGA) with Fulton County to formalize the reimbursement process. Under the proposed IGA, Fulton County will reimburse the City of Milton for the completed water main relocation work. The total estimated cost for the relocation and installation of the affected water mains is $284,800.00. This amount has been budgeted under the Water and Sewer Fund and is included in the County’s 2016-2026 Capital Improvement Program.
Community Impact: Fulton County operates an 8‑inch water main that serves properties along this section of Green Road. The road improvement project affected the existing water lines that serve developments in the area, as well as the broader water distribution system within the City of Milton. During construction, isolated water outages occurred as services were disconnected from the existing main and reconnected to the new main.
Department Recommendation: The Department of Public Works has found that the most cost‑effective approach to completing the necessary water main relocations is to allow the City of Milton to include the work in its bid for the Road Improvement Project. Therefore, the Department recommends that Fulton County enter into an Intergovernmental Agreement (IGA) with the City of Milton.
Project Implications: The road improvement along Green Road impacted the existing 8‑inch cast iron water mains due to grade modifications. These changes required the relocation of the water main and the adjustment of valves to match the proposed roadway surface. These relocations were needed to ensure uninterrupted water service in the area.
Community Issues/Concerns: During construction, water service was intended to be maintained; however, temporary interruptions may have occurred during tie‑ins with the existing water main.
Department Issues/Concerns: The Public Works Department is not aware of any issues or concerns with the proposed Intergovernmental Agreement (IGA). Similar arrangements between the City of Milton and Fulton County have been successful on past projects.
