Requirement for Board Action

Pursuant to Fulton County Code § 1-117, the Fulton County Board of Commissioners has exclusive jurisdiction and control over directing and controlling all the property of Fulton County, as they may deem expedient, according to law.

Summary & Background

 

Scope of Work: The City of Atlanta and the City of Atlanta and Fulton County Recreation Authority have requested that the Fulton County Board of Commissioners approve the Fourth Amendment to the Governmental Agreement among the City, the Authority, and the County for the purpose of removing an area approximately 1,955 square feet in size from the leased premises under the Agreement. The area to be removed is a small portion of property formally known as the Abana Courtyard (see depiction in Exhibit B attached hereto) and will thereafter be accessible to all patrons of Grant Park. The Department of Real Estate and Asset Management (DREAM) and the City of Atlanta have negotiated mutually acceptable rental terms to remove the Abana Courtyard area, subject to the approval of the Board of Commissioners.

 

The City of Atlanta Parks Department will complete all required onsite construction to repurpose the area for park services and provide ongoing maintenance once all planned construction is completed. All other terms within the Agreement will remain in effect and the County will not be required to participate in daily operations, maintenance or financially.

 

Community Impact: The City of Atlanta’s Park Department construction plans will optimize the subject area and positively impact public visits to the Atlanta Zoo and Grant Park for all by providing a safe, inclusive, and accessible environment. 

 

Department Recommendation: The Department of Real Estate and Asset Management, DREAM recommends approving the Fourth Amendment to Governmental Agreement to formalize the negotiated terms with the City of Atlanta.

 

Project Implications: The approval of the requested Fourth Amendment to Governmental Agreement will serve as a public affirmation of the collaborative partnership between Fulton County and the City of Atlanta, confirming a shared commitment to enhancing the delivery of government services for all residents and visitors throughout Fulton County and the city of Atlanta.
