Request approval of a Resolution approving an Easement Agreement between Fulton County, Georgia (Grantor) and Georgia Power Company (Grantee), for the purpose of granting utility easement access to connect substations at 901 Rice Street, Atlanta, Georgia, formally known as the Fulton County Jail; authorizing the Chairman to execute the Easement Agreement and related documents; authorizing the County Attorney to approve the Easement Agreement and related documents as to form and to make necessary modifications thereto prior to execution. Effective upon approval. (APPROVED UPON ADOPTION OF THE CONSENT AGENDA)

O.C.G.A. § 36-9-3(a)(3)(A) authorizes the granting of easements without a competitive process; and Fulton County Code § 1-117 gives the Fulton County Board of Commissioners exclusive jurisdiction and control over directing and controlling all the property of the county, as they may deem expedient, according to law.

Summary & Background Georgia Power Company has submitted a request to the Fulton County Department Real Estate and Asset Management (DREAM) to acquire a utility easement at the Fulton County Jail for the purpose of connecting two existing substations by installing two power lines between them. The connection of the two substations will increase electrical service reliability and efficiency levels for all surrounding customers including the Fulton County Jail.
DREAM and Georgia Power Company have reviewed the purposed construction drawings, negotiated mutually acceptable terms of settlement and revised the easement alignment to minimize impacts to jail operations and future development options.
Fulton County will receive $3,427,320.00 in compensation for 2.65+/- acres of utility easement area based on an independent appraisal completed for the property rights being acquired and remaining value of the property that will result from Georgia Power’s planned onsite service line installs. The funds received will be used to support physical improvements at the 901 Rice St. jail facility.
Pending approval, the utility easement purchased by Georgia Power Company will be recorded in public records and will grant Georgia Power Company access as necessary to perform construction, maintenance, and upgrades to their overhead utility service lines.
Community Impact: Planned improvements, once installed, will improve efficiency within the community, reduce power outages and the time required to make repairs when outages occur and allows Georgia Power Company to install infrastructure for future development.
Department Recommendation: The Department of Real Estate and Asset Management recommends approval of an Easement Agreement with Georgia Power Company as negotiated.
Project Implications: Negotiated terms of settlement with Georgia Power are consistent with county initiative of maintaining optimum efficiency and safety at all county facilities.
