GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. O.C.G.A § 36-10-1 provides that all official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Scope of Work: The Georgia Department of Transportation (GDOT) is currently planning to reconstruct I-285 westbound auxiliary lane extension from State Route 9/ Roswell Road to Riverside Drive, including the reconstruction of the Mount Vernon Highway Bridge in Fulton County. The GDOT Design Build (DB) will be responsible for relocating any existing sanitary sewer conflicts as a part of their contract with GDOT. GDOT will begin the procurement process for this the roadway improvement project in middle 2021 with a construction start date expected for the middle part of 2022. Before the procurement process is begun, GDOT has requested the execution of a MOU between Fulton County and GDOT. This will allow the GDOT DB team bid the design and construction of the sewer line relocations as part of their project. Once the DB team has been chosen by GODT, Fulton County would then the executed MUAA/MUAAA with the selected team after the award of the project. Any relocation cost of the existing sewer along in both directions of I-285 lanes construction improvements shall be covered by GDOT. The Department of Public Works believes that the most cost effective way to complete the sewer line relocations is by allowing the GDOT to bid out the work as part of their roadway project. Fulton County staff will be on-site during the relocation of the sewer line to ensure that its construction is done to Fulton County standards.
Community Impact: Currently, Fulton County has serving sewer lines along both directions of I-285 auxiliary lane extension. The road improvements will impact the existing sewer lines.
Department Recommendation: Public Works recommends that Fulton County enter into the MOU.
Project Implications: The road improvements impact the existing sewer line due to modifications of existing grades, road widening and auxiliary lanes extension along I-285 that requires sewer line to be relocated. Additionally, sewer manholes will be adjusted to match the proposed roadway surface. The existing sewer line relocations must occur to maintain sewer service in this area.
Community Issues/Concerns: During construction of the relocations, sewer service is to be maintained and temporary interruptions may occur during tie-ins with existing sewer line.
Department Issues/Concerns: The Public Works Department is not aware of any issues or concerns with this proposed MOU. This type of arrangement between the GDOT and Fulton County has worked well on past projects.
