Requirement for Board Action

Pursuant to Fulton County Code § 1-117, the Fulton County Board of Commissioners has exclusive jurisdiction and control over directing and controlling all the property of Fulton County, as they may deem expedient, according to law.

Summary & Background

 

Scope of Work: The City of Roswell is seeking approval from the Fulton County Board of Commissioners to execute a long-term lease agreement for County-owned real property located at 575 Riverside Drive, Roswell, Georgia 30075. The subject property is currently used as a park for residents of the City of Roswell and Fulton County.  The Department of Real Estate and Asset Management (DREAM) and the City of Roswell have negotiated mutually acceptable rental terms, subject to approval by the Board of Commissioners.

 

The City of Roswell has requested this long-term lease agreement be executed prior to completing planned improvements that include a new amphitheater facility, a new water-park feature, resurfacing and expansion of onsite parking lots, and new entrances. The initial lease term will be twenty-five (25) years, with an option to renew for an additional twenty-five (25) years. The annual rental rate will be set at one dollar ($1.00), with consideration for the rental provided through planned capital repairs, maintenance, and improvements to be completed by the City of Roswell at its own cost, as well as the added benefit of a new concert venue and water park for County residents.

 

In the event the County terminates the Lease for convenience prior to the Lease’s 20-year anniversary, the County has agreed to reimburse Roswell for the then-outstanding bond debt dedicated to Park improvements and renovations, with such amounts further described in the Ground Lease Agreement. 

 

Community Impact: A new lease agreement is required for the City of Roswell to continue occupancy and daily operations, as well as meaningful park improvements and expansions. This initiative is expected to have a meaningful and positive impact on the surrounding community by providing a safe, inclusive, and accessible environment for residents to enjoy the planned park facilities.

 

Department Recommendation: The Department of Real Estate and Asset Management, DREAM, recommends approving the Ground Lease Agreement to formalize the negotiated rental terms with the City of Roswell.

 

Project Implications: The approval of a long-term Ground Lease Agreement will serve as a public affirmation of the collaborative partnership between Fulton County and the City of Roswell, confirming a shared commitment to enhancing the delivery of government services for all residents and visitors throughout Fulton County.
