Scope of Work: House Bill 885 (Laws 201, Act 467, § 1, effective April 27, 2016)  repealed O.C.G.A. § 31-3-2.1, which had allowed Fulton County to operate its public health services through its internal Department of Health and Wellness.  

Adoption of House Bill 885 transferred responsibility for the daily operations of the County’s eight (8) Public Health Services Facilities from being the responsibility of a department within the County to being a County Board of Health responsibility.  Approval of agenda items 17-0298 and 17-0299 at the Fulton County Board of Commissioners Meeting held April 12, 2017 dissolved Fulton County Department of Health and Wellness and created Fulton County Board of Health as a separate entity.  On December 16, 2020, agenda item 20-0622 was approved by the Fulton County Board of Commissioners, approving Resolution 20-0622 which provided for the Chairman to execute the First Amendment to the Intergovernmental Agreement for the Provision Services between the County and the Fulton County Board of Health.  The Intergovernmental Agreement provided that the County would comply with  all legal obligations under applicable law in relation to the Fulton County Board of Health, to include providing quarters and equipment as set out in O.C.G.A. § 31-3-9 and information technology services for a limited period of time.  
                     

Accordingly, the Fulton County Board of Health and Department of Real Estate and Asset Management (“DREAM”)  have agreed to a Master Lease Agreement for their continued occupancy of County owned real properties or facilities leased  by the County for health services.  The Fulton County Board of Health and the Information Technology Department (“IT”) have agreed to a scope of work to provide to the Fulton County Board of Health, at a cost.  The Fulton County Board of Health and the Purchasing Department have negotiated a vehicle use agreement for that allows the Fulton County Board of Health to use two of the County’s vehicles purchased with C.A.R.Es Act Funds.  The agreements between the Fulton County Board of Health and IT and Fulton County Board of Health and the Purchasing Department were approved by the County’s Chief Financial Officer and drafted by the County Attorney’s Office.  
                     

The County Manager’s Office and Fulton County Board of Health and are requesting the approval of the Board of Commissioners to approve the resolution and execute and three of the agreements.

 

Community Impact: Approval of Resolution and the Restatement and Second Amendment of the Intergovernmental Agreement will not impact health services for county residents in communities with County health facilities.  Fulton County residents will have continuous access to the same health services within their community which is consistent with the County’s initiative that all people trust government is efficient, effective and fiscally sound.

 

Department Recommendation: County Manager’s Office, DREAM, FCIT, and the Purchasing Department recommends approval of the Resolution and the Restatement and Second Amendment of the Intergovernmental Agreement between Fulton County, Georgia, and the Fulton County Board of Health for the purpose of providing quarters, equipment, and IT services to the Fulton County Board of Health.

 

Project Implications: Approval of Resolution of the Restatement and Second Amendment of the Intergovernmental Agreement will formalize the terms between Fulton County and the Fulton County Board of Health.
