Requirement for Board Action

Pursuant to O.C.G.A. § 36-9-3, Fulton County has authority to sell, grant, lease, rent, convey, or transfer any real property owned by the County, and pursuant to FCC § 1-117, the Board of Commissioners are vested with exclusive jurisdiction to direct and control all the property in the County, according to law.

Summary & Background

 

Scope of Work: The Department of Real Estate and Asset Management - Land Division staff received a request from the Metro Atlanta Land Bank (Land Bank) to execute a Corrective Quit Claim Deed for the purpose of adding a legal description for one of seven (7) parcels that Fulton County previously transferred to the Land Bank. 

 

The Fulton County Board of Commissioners previously approved the transfers of the parcels on March 15, 2006 as Agenda Item 06-0246. Corrective quit claim deeds are required to include the correct legal descriptions for the following parcels:

 

(1)                     755 Coleman Street, Atlanta, GA (Tax ID 14-0086-0007-051-4)

(2)                     756 Simpson Street, Atlanta, GA (Tax ID 14-0110-0002-140-0)

(3)                     1150 Hunter Place, Atlanta, GA (Tax ID 14-0116-0001-001-9)

(4)                     1005 Dimmock Street, Atlanta, GA (Tax ID 14-0119-0004-049-2)

(5)                     Dimmock Street, Atlanta, GA (Tax ID 14-0119-0004-051-8)

(6)                     1368 Lucille Avenue, Atlanta, GA (Tax ID 14-0140-0008-118-4)

(7)                     Third Street, Atlanta, GA (Tax ID14-0207-0001-057-1) 

 

Community Impact: Execution of the corrective deeds will allow the Metro Atlanta Land Bank to actively market the properties for private sale and return the properties to the tax rolls.  

 

Department Recommendation: The Department of Real Estate and Asset Management recommends approval of the Resolution to execute corrective quit claim deeds for the seven parcels previously conveyed to the Metro Atlanta Land Bank.  

 

Project Implications: Execution of the corrective quit claim deeds will allow the Metro Atlanta Land Bank to sell the subject properties for redevelopment.
