The BOC has the authority to amend the contract pursuant to Fulton County Code (“FCC”) § 102-420, which states that contract modifications within the scope of the contract and necessary for completion of the contract, in the specifications, services, time of performance or terms and conditions of the contract shall be forwarded to the BOC for approval.  In addition, pursuant to O.C.G.A. Sec. 36-10-1, all contracts entered into by the County governing authority with other persons in behalf of the County shall be in writing and entered on its minutes;

Summary & Background: The work under this project will further the existing 30% design of the Boat Rock Sanitary Sewer to an 80% design level and provide a guaranteed maximum price (GMP) to construct the improvements. This project was initiated through the petition sewer process by the surrounding community who are currently served by individual septic tanks.

 

Scope of Work: This project was originally awarded to Garney + Gresham Smith (Atlanta, GA) under Agenda Item No. 250978 at the December 17, 2025, regular meeting.  Subsequently, the Garney Companies Inc. representative advised the County that the correct contracting entity and prime contractor is Garney Companies, Inc. and that Gresham Smith is a major subconsultant, and so part of the Team, but is not a joint venture partner.  As a result, the evaluation scoring was revised and the points assigned for local preference were removed because those points had been awarded because of Gresham Smith’s location.  Since Gresham Smith is not a joint venture partner, the local preference points cannot be assigned.  After the scoring revision, the evaluation committee’s overall top ranked proposal recommendation remains the same and Garney Companies, Inc. remains the highestscoring responsive proposer. The revised scoring evaluation is reflected in Exhibit #1, which is attached

Project Implications: The name of the contracting entity must be corrected in order to move forward with the project.

 

Community Issues/Concerns: This is a petition-based sewer project, initiated at the request of a majority of residents directly affected by the proposed facilities. The community has expressed strong support for the project and have formally requested its implementation.

 

Department Issues/Concerns: The Public Works Department does not have any issues or concerns regarding awarding this contract to The Garney Companies, Inc.
