Under Article III, Section 82-188 of the Fulton County Code of Laws, the County Manager’s designee (Public Works Director) may request that the Board of Commissioners extend sanitary sewer service to address situations adverse to the public health.

Summary & Background Under Article III, Section 82-188 of the Fulton County Code, property owners along a roadway may petition the Department of Public Works and the Board of Commissioners to extend the County’s sanitary sewer to address public health concerns when over 50% of those along the roadway frontage support the need.

 

The majority of the parcels within this petition are less than 1 acre and were constructed between 1955 and 1970. The underground septic tanks and their corresponding drainage fields are beyond their expected design lifespan. The great risk of failure posed by these systems has the potential to severely compromise the public health and to negatively impact the environment. The closest publicly owned sewer is North within 200 linear feet of each street within this petition.

 

Fifty-nine (59) percent of property owners along Manning Drive, Pinetree Circle and Cold Creek Drive have petitioned the Department of Public Works to install approximately 2,920 linear feet of 8-inch sanitary sewer. The proposed sewer will serve forty-nine (49) total properties with twenty nine (29) of the property owners having signed the petition requesting this project. 

 

If approved by the Board of Commissioners, all forty-nine (49) property owners will pay an assessment of $20.00 per linear foot of frontage for a total assessment of $113,170.00. In addition, each resident that connects to the sewer system will pay the current sewer connection permit fee of $3,183.00.

 

Scope of Work: The Department of Public Works is requesting that the sewer extension project be funded for a complete design and all construction activity through the existing on-call, standby consultant and contractor contracts

 

Community Impact: Installation of this petition sanitary sewer would provide access to property owners with failing septic systems. Access to the publicly-owned treatment works will help mitigate the impact of potential future failures.   

 

Department Recommendation: The Department of Public Works recommends approval of this item.

 

Project Implications: This project, if approved, will add fifty-one (51) new sanitary sewer customers to Fulton County. Also there is a greater possibility of spills occurring from failed septic systems if sanitary sewer through this petition is not provided.

 

Community Issues/Concerns: A majority of the property owners along the frontage of this proposed project are concerned that their septic systems will fail in the future with them not having the ability to connect to the publicly owned treatment works that is operated and maintained by Fulton County. This has the potential of being detrimental to the health and safety of the neighboring community.

 

Department Issues/Concerns: None.  The Department of Public Works has the expertise, staff, and ability via existing contracts to complete this project.
