In accordance with Purchasing Code Section 102-416(g), the purpose of the closeout process is to verify that both parties to the contract have fulfilled their contractual obligations and that no responsibilities are remaining. A contract is completed when all goods and services have been received and accepted; all reports have been delivered and accepted; all administrative actions have been accomplished; all county-furnished equipment and material have been returned; and final payment has been made to the contractor.

Summary & Background: This request is to close-out the contract with Averhealth in order to finalize selection of a new vendor and issuing the new vendor contract took longer than expected. Completion of the transition to the new vendor was effective November 1, 2025.  This delay required us to maintain services under the existing contract longer than originally planned to prevent any disruption in program operations.

 

Additionally, we were undertaking a significant program consolidation effort involving five programs across two locations. This consolidation required substantial planning, coordination, and ramp-up time with the new vendor to ensure a seamless and successful rollout. To maintain service continuity and quality during this transition period, it was necessary to continue utilizing the previous vendor’s services until the new vendor was fully operational.

 

As a result, the contract remained active longer than expected, leading to a higher final closeout amount. These costs were essential to ensure uninterrupted service delivery and a smooth transition to the new vendor.

 

Scope of Work: Aversys is a proprietary web-based application that integrates individual client random selection and notification, same gender directly observed sample collections, clinical laboratory analysis, results reporting and event notification, and other related activities.  As the contractor, Avertest, LLC will be responsible for providing drug testing services for the Fulton County DUI Treatment Court. The drug testing services provide measurement-based systematic monitoring services for program participants and will foster coordination of care and supervision and help clients abstain from substance use and achieve stability within the community.  The market demonstrates that the services sought are so unique that only one vendor can satisfy the program’s requirements.  It would require procuring these services from other service providers would require the coordination of multiple vendors to achieve a comparable level of client care.  For example, there are service providers within Georgia that provide employment-related, non-observed sample collection services but send samples to independent laboratories. There are labs that conduct testing in Georgia but do not provide directly observed sample collection services. Averhealth, on the other hand, offers Fulton County both directly observed collections and our own lab testing, ensuring evidence-based practices and integrated services designed to help clients with SUD develop lasting healthy habits.

 

Community Impact: Consistent and uninterrupted drug testing allows the program to closely monitor participant progress and intervene immediately should any return to drug or alcohol use; therefore, mitigating against further violations of the law and or community expense. 

 

Department Recommendation: The Fulton County State Court recommends approval.

 

Project Implications:  Early intervention upon a return to drug and/or alcohol use should increase participant success in the program and mitigate against additional violations of the law.  

 

Community Issues/Concerns: The ability to utilize drug testing services is required to be in compliance with the Accountability Courts Best practices/Standards and receive grant funds
