Summary & Background (First sentence includes Agency recommendation. Provide an executive summary of the action that gives an overview of the relevant details for the item.)

The agency recommendation and request are that this item be approved.

The Probate Judge of Fulton County has determined that the efficiency and success of the Fulton County Probate Court would be served by the appointment of an Associate Judge position to hear more contested matters due to the County’s rising population, increased demand, and increased complexity of cases. This position would further allow for continuity of leadership during emergencies and for operations to continue when the Probate Judge of Fulton County is away or otherwise unable to serve.  The appointment of an associate judge has been recommended by the Probate Judges’ Council of Georgia for counties with over 90,000 residents. Associate Probate Judges are found in the Probate Courts of the largest 3 counties in Georgia, excluding Fulton County. This resolution is an attempt to align Fulton County’s resourcing and time-standards with similar counties.

Scope of Work: This position would serve Probate Court by hearing contested guardianship and estate matters with attorneys and self-represented litigants. Hearing cases, drafting orders and training staff would be the daily, full-time duties of this position.

Community Impact: With the appointment of an Associate Probate Judge, contested matters would be heard by a judge sooner, resulting in quicker more efficient resolution of contested matters.
