O.C.G.A. § 36-60-13 authorizes each county or municipality in this state to enter into multiyear lease, purchase, or lease purchase contracts of all kinds for the acquisition of goods materials, real and personal property, services and supplies.  O.C.G.A. § 36-10-1 also requires that all contracts entered into by a county governing authority be in writing and entered on its minutes.

Summary & Background

 

Scope of Work:

 

The approval of the Fulton County Board of Commissioners is being requested by the Department of Emergency Services (E911) and the Department of Real Estate and Asset Management (DREAM) to execute a Radio Communications Tower Lease Agreement with the Georgia Technology Authority (GTA).  The Board of Commissioners, via Agenda Item 15-0316 on April 15, 2015, previously approved a Lease Agreement between the parties for the same property (“Original Agreement”) for the purpose of providing emergency communication services for the benefit of the public. This new Lease Agreement allows the County to continue to lease the property from GTA for uninterrupted radio communications services.  

 

The initial term of the agreement shall be effective upon the approval of the Fulton Board of Commissioners through December 31, 2025, and the agreement has nine (9) optional one-year renewal periods. Fulton County will not be required to make monetary rental payments during the initial or any permitted renewal term of the agreement.

 

This Lease Agreement between Fulton County and GTA is required to formalize the terms on which the Fulton County Department of Emergency Services’ communication equipment will be allowed to remain attached on the cell tower structure located 5651 Stonewall Tell Road, College Park, Georgia.

 

Community Impact: Approval of a new Lease Agreement will allow the Fulton County Department of Emergency Services to continue to provide emergency communication services from this location.

 

Department Recommendation: The Department of Real Estate and Asset Management recommends approval of the attached Lease Agreement for the purpose of extending the County’s occupancy on the same terms and conditions of the original lease agreement.

 

Project Implications: Emergency Services will have the benefit of continued occupancy at a desired location without incurring the costs to relocate to an alternate location.
