GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. In addition, O.C.G.A § 36-10-1 provides that all official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Summary & Background:
Scope of Work: The City of Roswell is planning improvements to Old Alabama Road between Big Creek Park and Wooten Road. The project includes road widening with landscaped medians and enhanced sidewalk infrastructure. As part of this roadway improvement, two (2) fire hydrants and ten (10) valve boxes with associated appurtenances will need to be relocated or adjusted within the existing right‑of‑way. Water service will remain uninterrupted throughout the construction period. The City of Roswell is planning to bid the roadway improvements in August 2026. The City is requesting execution of an Intergovernmental Agreement (IGA) with the County to allow the inclusion of fire hydrant relocations and valve box adjustments as part of the roadway project. Fulton County will reimburse the City of Roswell after the construction work is completed by the City's contractor. Fulton County staff will be on-site during the water main relocation to ensure that all work meets Fulton County standards. The cost of relocating and installing the affected water infrastructure is $35,400.00, which has been budgeted in the Water and Sewer Fund and included in the 2016-2026 Capital Improvement Program.
Community Impact: Fulton County currently operates a 42‑inch transmission line and a 12‑inch water main serving properties along this section of Old Alabama Road. The planned road improvements will impact existing fire hydrants and valve boxes that support development in the area, as well as portions of the distribution system extending into the City of Roswell. During construction, there will be isolated water outages as services are disconnected from the existing water main and reconnected to the new main.
Department Recommendation: The Department of Public Works believes that the most cost-effective way to complete the fire hydrant relocations and valve box adjustments is to allow the City of Roswell to bid out the work as part of their roadway project and therefore recommends that the County enter into the proposed IGA.
Project Implications: The road improvements impact the existing fire hydrants and valve boxes due to modifications of existing grades with road widening along Old Alabama Road that require the water main to be remain. The existing fire hydrants relocations and valve boxes adjustment must occur to maintain water service in this area.
Community Issues/Concerns: During construction of the relocations, water service is to be maintained and temporary interruptions may occur during tie-ins with the existing water main.
Department Issues/Concerns: The Public Works Department is not aware of any issues or concerns with the IGA. This type of arrangement between the City of Roswell and Fulton County has worked well on past projects.
