GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. Further, O.C.G.A § 36-10-1 provides that “[a]ll official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.”

Summary & Background:

 

Scope of Work: The Georgia Department of Transportation (GDOT) is currently planning improvements to add two (2) new, barrierseparated express lanes in both directions of I285 between the Chattahoochee River and Burnt Fork Creek, and in both directions of SR 400 from Northland Drive to the North Springs MARTA Station in Fulton and DeKalb Counties. As part of this project, GDOT’s contractor will be responsible for relocating any existing sanitary sewer facilities that conflict with the proposed roadway improvements. GDOT anticipates beginning the procurement process for this project in CYQ3 2026, with construction expected to begin in CYQ2 2027. Prior to initiating procurement, GDOT has requested the execution of a Memorandum of Understanding (MOU) between Fulton County and GDOT. This MOU will allow the GDOT PublicPrivate Partnership (P3) team to include the design and construction of sewer line relocations in its project bid. Once the P3 team has been selected by GDOT, any costs associated with relocating the existing sewer facilities along both directions of the I285 Express Lanes and SR 400 project will be fully covered by GDOT. Fulton County staff will be onsite during the sewer relocation activities to ensure all work is performed in accordance with Fulton County standards.

 

Community Impact: Fulton County currently has sewer lines located along both directions of the I285 Express Lanes and SR 400. The planned roadway improvements will impact these existing sewer facilities, which serve developments in the area as well as the broader Fulton County collection system. As part of the project delivery process, the relocation of the existing sewer lines will be fully funded through the Georgia Department of Transportation (GDOT) PublicPrivate Partnership (P3) contract.

 

Department Recommendation: The Department of Public Works believes that the most costeffective approach to completing the required sewer line relocations is to allow GDOT to include this work in its roadway construction contract. Therefore, the Department of Public Works recommends that Fulton County enter into the PublicPrivate Partnership (P3) agreement and the Memorandum of Understanding (MOU).

 

Project Implications: The roadway improvements will impact existing sewer lines due to modifications to current grades and the widening required for the Express Lanes along I285 and SR400, making sewer line relocations necessary. In addition, sewer manholes will be adjusted to match the proposed roadway surface. These sewer line relocations are required to ensure continued and reliable sewer service in this area.

 

Community Issues/Concerns: Sewer service will be maintained throughout the construction period. However, temporary service interruptions may occur during construction between the new and existing sewer lines. Impacted customers will be notified in advance.

 

Department Issues/Concerns: The Public Works Department is not aware of any issues or concerns with this proposed P3 & MOU. This type of arrangement between GDOT and Fulton County has worked well on past projects.
