Request approval of a resolution approving a Second Amendment to Utility Access and Services Agreement between Rejv Concourse Atlanta, LLC, and Fulton County, Georgia, a political subdivision of the State of Georgia, at 5 Concourse Parkway, Atlanta, Georgia; to authorize the County Attorney to approve a Second Amendment to Utility Access and Services Agreement as to form and substance and to make any modifications thereto in order to protect the interests of Fulton County; to authorize the Chairman to execute the Second Amendment to Utility Access and Services Agreement; and for other purposes.

Scope of Work: The approval of the Fulton County Board of Commissioners is being requested by the Department of Emergency Services to extend occupancy and to amend the rental terms of the License Agreements previously approved as Agenda Item #198 at the Board of Commissioners’ Meeting held May 20, 1992 and Agenda Item # 16-0567 approved at the Board of Commissioners’ Meeting held July 20, 2016, for the purpose of providing rooftop space for emergency communication equipment. In accordance with County Policy, the approval of the Fulton County Board of Commissioner’s is required to modify or extend the term of all contractual agreements in which the County is a party to the agreement. Pending approval of the Board of Commissioners effective January 1, 2021, the effective monthly rental payments of One Thousand One Hundred Thirty One and 42/100 ($1,131.42) dollars will become payable. Effective on the annual anniversary of the Commencement Date (January 1st), the monthly rental rate will be increased annually during the License Term and any Renewal Term by two and one half percent (2.5%) of the annual installment of Rent payable during the previous year.
Community Impact: Approval of a Second Amendment to Utility Access and Services Agreement will allow the Fulton County Department of Emergency Services to continue to provide emergency communication services from this location.
Department Recommendation: The Department of Real Estate and Asset Management and the Fulton County Department of Emergency Services recommends approval of the attached Second Amendment to Utility Access and Services Agreement for the purpose of extending the term and conditions of the current agreement.
Project Implications: : Emergency Services will have the benefit of continued occupancy at the current desired location without incurring the costs to relocate to an alternate location.
