Requirement for Board Action)

According to Article XXXIV. - Development Regulations, 34.4.1 Land disturbance permit prerequisites. In addition, pursuant to Fulton County Code Section 1-117, the Board of Commissioners has exclusive jurisdiction and control in directing and controlling all the property of the County, as they may deem expedient, according to and to exercise such other powers as are granted by law, or are indispensable to their jurisdiction over County matters.

Summary & Background

 

Scope of Work: The proposed Medley Johns Creek Phase 2 Project, a mixed-use development, requires a water vault easement dedication. Fulton County development regulations require that all new water service line connections acknowledge Fulton County’s ownership interests in the area(s) where a connection is being made to the County’s water system before recording the Final Plat. The easement area to be conveyed consists of 604 square feet and is in Land Lots 398 and 399 of the 1st District, 1st Section of Fulton County, Georgia.

 

Community Impact: The community will benefit from the extension of the County’s water system and the addition of a mixed-use development.

 

Department Recommendation: The Department of Real Estate and Asset Management recommends acceptance of the easement dedication. 

 

Project Implications: Easement dedications by the legal owner of record to Fulton County are made a part of public records and grant Fulton County access as necessary to perform construction, maintenance, and upgrades to the water system once the proposed improvements are installed on the owner’s property.
