Requirement for Board Action

GA CONST Art. 9, § 3 ¶1, provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services. Further, O.C.G.A § 36-10-1 provides that all official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Summary & Background The purpose of this Agreement is to memorialize an arrangement between the Parties regarding the provision of TB testing for Fulton County Adult Day Health program staff and volunteers by the Board of Health and reimbursement of same by Fulton County.

Scope of Work: The Fulton County Board of Health will provide TB testing to the Fulton County Adult Day Health program staff and volunteers at no upfront cost. The Board of Health shall bill the County monthly for any such TB testing that the Board of Health provides at a rate of $30.00 per test, which the County shall pay promptly within thirty (30) days. Adult Day Health program staff and volunteers who provide direct care to participants are required to receive a report of physical examination by an authorized healthcare professional within twelve months prior to employment, to include documentation and evidence that all staff/volunteers are free of active tuberculosis (“TB”) based upon the results of a negative tuberculin skin test or chest x-ray within twelve months prior to employment; See Ga. Comp. R. & Regs. R. 111-8-1-.14.

Department Issues/Concerns: If agreement is not approved, employees will be responsible for paying for TB testing out of pocket which puts the County’s compliance at the mercy of the employee’s ability to afford the test.
