Request approval of a Resolution authorizing the transfer of 3,043.92 square feet of real property and the execution of a temporary construction easement covering approximately 1,535.01 square feet to the City of Sandy Springs, a municipal corporation of the State of Georgia, for the purpose of allowing the City to make sidewalk and streetscape improvements at 5025 Roswell Road, Sandy Springs Georgia; to authorize the Chairman to execute an appropriate deed, a temporary construction easement agreement, and all other necessary documents; to authorize the County Attorney to approve the deed, the temporary construction easement, and related documents as to form and to make modifications thereto to protect the interests of Fulton County prior to execution; and for other purposes. Requirement for Board Action
Pursuant to Fulton County Code § 1-117, the Board of Commissioners has exclusive jurisdiction and control over directing and controlling all the county’s property as they may deem expedient, according to law. O.C.G.A. § 36-9-3 authorizes Fulton County to sell, grant, lease, rent, convey, or transfer any real property owned by the County to another body politic without a competitive process.

Summary & Background
Scope of Work:
The City of Sandy Springs (the “City”) submitted a request to the Department of Real Estate and Asset Management (“DREAM”) to acquire 3,043.92 square feet of real property to be used as right-of-way and a temporary construction easement covering 1,535.01 square feet to facilitate sidewalk and streetscape improvements along Roswell Road. The City’s acquisition of the real property and the temporary easement area is necessary to support a planned transit and streetscape improvement project within the Roswell Road corridor.
An appraisal of the requested real property and easement rights determined the fair market value to be $182,000.00.
Community Impact: Approval for DREAM to complete the sale of real property rights to the City of Sandy Springs will not adversely affect County operations at the former behavioral health facility. The planned streetscape project includes roadway and pedestrian improvements intended to enhance safety and improve travel conditions for both motorists and pedestrians.
Department Recommendation: DREAM recommends that the Fulton County Board of Commissioners approve the conveyance of the requested real property and temporary construction easement area from the County-owned property located at 5025 Roswell Road, Land Lot 93 of the 17th District, to the City of Sandy Springs.
Project Implications: The planned sidewalk and streetscape improvements will help revitalize the City’s commercial corridors by fostering a safer, more walkable, and vibrant environment for residents, businesses, and visitors along Roswell Road.
