Scope of Work: The Service Delivery Strategy Act requires cities and counties to coordinate the planning and provision of services so as to avoid unnecessary overlap and duplication. The Act further requires cities and counties to generate an agreement for the provision and funding of services and provides penalties for the failure to timely do so. The cities within Fulton County and Fulton County went through a dispute resolution process and all parties have now agreed upon the language and substance contained within the Agreement.
The Georgia Service Delivery Strategy Act, O.C.G.A. § 36-70-20 et seq. (the “SDS Act”), requires each county and the municipalities located therein to develop and maintain a Service Delivery Strategy designed, among other purposes, to promote the efficient provision of local government services and avoid unnecessary duplication and overlap of such services.
Fulton County and the municipalities located therein have worked collaboratively over the past several months to resolve the outstanding issues concerning the Fulton County Service Delivery Strategy, and have agreed to and finalized a Service Delivery Strategy for submission to DCA; with some remaining services in dispute for some jurisdictions.
Community Impact: None is expected since this Agreement is essentially a compendium of previous agreements already executed by the County and the Cities.
Department Recommendation: The County Manager’s Office recommends the adoption of the resolution and submittal of the agreement to Department of Community Affairs (DCA), with all existing and executed contracts for services even if all cites have not agreed with all terms in order to meet stated deadlines for review and approval.
Project Implications: The Service Delivery Strategy is required by state law and must be submitted to DCA to ensure Fulton County and the cities within Fulton County remain in compliance with state regulations.
Community Issues/Concerns: Currently there are existing and executed contracts with the City of South Fulton for Fire Services and 911 Services. The City of South Fulton has expressed concerns and unsuccessfully attempted to modify the Fire Services IGA that expires on December 31, 2026. The City of Atlanta and Sandy Springs continue their dispute over water distribution services and are in mediation.
Department Issues/Concerns: The County is allowed to submit the SDS documents to DCA under the new law and regulations even if some cities are in dispute as long as there are existing contracts for services.
