O.C.G.A. Section 36-10-01 states that all contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered in its minutes. The County’s Consolidated Plan and Annual Action Plan updates are governed by 24 C.F.R. Section 91.200.

Summary & Background On May 19, 2021, the Board of Commissioners approved a Resolution to accept the 2021 Department of Housing and Urban Development (HUD) allocation (Agenda Item # 21-0374). Since that time, the HOME Investment Partnership Program has identified budget requirements to support the 2021 HOME grant funds. This Agenda Item is requesting approval of a Substantial Amendment to the HUD 2021 Annual Plan to include the revised HOME budget.
Scope of Work: The Department of Community Development received a $670,081 2021 HOME allocation. According to Section 231 of NAHA and 24 CFR 92.300(a)(1), HUD requires jurisdictions to set aside 15% of each annual allocation of HOME funds for housing that is only owned, developed, or sponsored by Community Housing Development Organizations (CHDO). HUD waived this set aside for the years 2017-2020 and reinstated the CHDO requirement for 2021. As such, the Department is requesting approval to transfer $105,600 of 2021 HOME grant funds from Tenant Based Rental Assistance (TBRA) to CHDO in order to comply with HUD’s 15% set aside requirement. In turn, TBRA will be reduced to $371,400 and $105,600 would be set aside for CHDO.

Community Impact: HUD Entitlement funding for HOME and CDBG will help the County provide services for its low and moderate-income citizens.
Department Recommendation: Approve the requested action.
Project Implications: Approval for the use of these funds will increase the Community Development Department’s ability to timely provide community development services to Fulton County citizens who reside outside of Atlanta.
Community Issues/Concerns: HOME proposed budgets were publicly advertised on December 15, 2021 for a 30 day period with a public hearing held on January 6, 2022 at 6PM via Zoom. There were no community issues or concerns.
Department Issues/Concerns: If the Substantial Amendment to the HUD 2021 Action Plan is not approved, it will limit the County’s ability to release and exhaust grant funds and respond to community development needs of low to moderate income communities within Fulton County.
