Pursuant to Fulton County Code Sec. 1-117, the Board of Commissioners has exclusive jurisdiction and control over directing and controlling all the county’s property as they may deem expedient, according to law. O.C.G.A. Sec. 36-9-3(a)(2)(A) authorizes the granting of rights of ways without a competitive process.

Scope of Work: The City of South Fulton has submitted a request to the Department of Real Estate and Asset Management (“DREAM”) to acquire approximately 14,853.96 square feet of right of way for the replacement of the bridge at the intersection of Cochran Mill Road and Camp Creek. The City of South Fulton’s fee simple ownership of the requested land areas is necessary for the construction and maintenance of the slopes required to improve stormwater management and the replacement of the roadway bridge that crosses Camp Creek at Cochran Road.   

 

The requested land area of 14,853.96 square feet is located within the 100-year flood plain and is not necessary for Fulton County’s operations.  

 

Approval of the Fulton County Board of Commissioners is being requested to complete the donation of property rights to the City of South Fulton that are necessary to complete the planned bridge replacement and improvements to the onsite stormwater management system.

 

Community Impact: Approval of the request to transfer real property rights to the City of South Fulton will not adversely impact the residents of the community in which the subject real property is located. The proposed construction is being completed to prevent flooding, reduce soil erosion, and maintain the roadway’s structural integrity by replacing the bridge that crosses Camp Creek at Cochran Mill Road.

 

Department Recommendation: It is the recommendation of DREAM that the Fulton County Board of Commissioners convey the requested fee simple right of way area totaling 14,853.96 square feet from the property owned at 7600 Cochran Mill Road to the City of South Fulton. The subject property being requested is located within the 100-year flood plain, is not essential for operations, and the planned bridge replacement will benefit all residents and visitors of Fulton County.

 

Project Implications: Planned bridge replacement and improvements to the slopes will improve travel safety for residents and stormwater drainage within the community.

Staff recommends the requested property rights be conveyed at no charge given the benefits of the bridge replacement and the limited utility of the subject area because of its location in the 100-year flood plain.
