GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. O.C.G.A § 36-10-1. All official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Scope of Work: The Georgia Department of Transportation (GDOT) is currently planning to rebuild the Interchange at I-285/I-20 on the western portion of Fulton County. The project will include the I-285/I-20 construction and other improvements along the key interchanges, including Fulton Industrial Boulevard. The GDOT Public Private Partnership (P3) will be responsible for relocating any existing sanitary sewer conflicts as a part of their contract with GDOT. GDOT will be bidding on the roadway improvements in the near future and has requested the execution of a P3MOU between Fulton County and GDOT. This will allow the GDOT Public Private Partnership (P3) to bid (excluding betterment) sewer relocation and installation work as part of their project. Relocation cost of the existing sewer line along Fulton Industrial Boulevard at I-20 construction improvements will be covered by the GDOT Public Private Partnership (P3). Fulton County staff will be on-site during the relocation of the water main to ensure that its construction is done to Fulton County standards.
Community Impact: Currently, Fulton County has serving sewer lines along Fulton Industrial Boulevard. The interchange improvements will affect the existing sewer lines that serve the developments in this area. Relocation cost of the existing sewer line shall be covered by the GDOT Public Private Partnership (P3).
Department Recommendation: The Department of Public Works believes that the most cost effective way to complete the sewer line relocations is by allowing the GDOT to bid out the work as part of their roadway project. Therefore, Public Works recommends that Fulton County enter into the P3MOU.
Project Implications: The GDOT interchange improvements impact the existing sewer line due to modifications of existing grades and road widening along Fulton Industrial Boulevard & I-20 that requires sewer line to be relocated. Additionally, sewer manholes will be adjusted to match the proposed roadway surface. The existing sewer line relocations must occur to maintain and service in this area.
Community Issues/Concerns: During construction of the relocations, sewer service is to be maintained and temporary interruptions may occur during tie-ins with existing sewer lines.
Department Issues/Concerns: The Public Works Department is not aware of any issues or concerns with this proposed P3MOU. This type of arrangement between the GDOT and Fulton County has worked well on past projects.
