Fulton County Code § 1-117 gives the Fulton County Board of Commissioners exclusive jurisdiction and control over directing and controlling all the property of the county, as they may deem expedient, according to law.

Summary & Background

 

Scope of Work: The Fulton County Department of Real Estate and Asset Management (DREAM) received a request from the City of Atlanta Parks and Recreation Department for legal access to County-owned property at 0 Fort Extension Street Atlanta, Georgia, formally known as Dobbs Plaza.  The subject property is presently in use as a pocket park for residents and visitors to the city of Atlanta, and the City requested access to complete ongoing maintenance of the park.  

 

DREAM and the City of Atlanta have negotiated mutually acceptable terms for a Right of Access License and Maintenance Agreement that will formalize the City of Atlanta’s permitted access and maintenance responsibilities.

 

Approval of the Fulton County Board of Commissioners is being requested to grant access for an initial term of ten (10) years from the effective date of the Agreement with one ten (10) year renewal option

 

Community Impact: Approval by the Board of Commissioners to execute this Right of Access License and Maintenance Agreement with the City of Atlanta for Dobbs Plaza will not adversely impact the community and will allow the City of Atlanta Parks and Recreation Department to continue to provide landscaping and maintenance services for the pocket park onsite.  

 

Department Recommendation: The Department of Real Estate and Asset Management recommends approval of the Right of Access License and Maintenance Agreement between Fulton County and the City of Atlanta for the purpose of formalizing terms of access for the City of Atlanta to complete all required maintenance and requested use of Dobbs Plaza.  

 

Project Implications: Dobbs Plaza is a pocket park within the historic Auburn Ave community, pending approval of the Right of Access License and Maintenance Agreement the City of Atlanta will provide ongoing maintenance of the pocket park at no cost to Fulton County.
