Scope of Work: The Fulton County Sheriff’s Office is requesting the approval of the Fulton County Board of Commissioners to expand the demised premises at 5615 Old National Highway, College Park, Georgia from approximately 1,892 square feet to 5,850 square feet of office space and to extend the current lease term for a period of ten years.  Lansky Partnership, LLLP, the Fulton County Sheriff’s Office and the Fulton County Department of Real Estate and Asset Management, DREAM have developed mutually acceptable renovation plans and lease terms that will consolidate and improved current services provided by the Fulton County Sheriff’s Office at this leased location.  In accordance with Fulton County Policy, the approval of the Fulton County Board of Commissioners is required prior to executing or modifying the terms of all contractual agreements in which the County is a party to the agreement.  Pending the Lessor’s performance of all of its obligations with respect to the renovation of the expanded space and the County’s written acceptance of the newly expanded premises, the monthly rental payment of $10,237.50 per month shall become effective.  Annual escalation of rents shall be deferred in exchange for the increases of 3% in Years 3 and 6 and 9% in Year 9.  In no event shall this lease continue beyond December 31, 2032 unless extended by mutual consent. 

 

Community Impact: Extension of the current lease and expansion of the leased space will improve service delivery and efficiency for the operations of the Sheriff’s Department within this community.

 

Department Recommendation: The Department of Real Estate and Asset Management recommends approval of the Fourth Amendment to Master Lease Agreement for the purpose of completing planned renovations, expansion of office space and extension of the current lease term for a period of ten years.  

 

Project Implications: Expansion of space will allow the Sheriff’s Office to achieve   departmental objectives, consolidate certain operations and improve service efficiency levels with no interruption in service delivery.

History of BOC Agenda Item:  Original full service lease agreement was approved as Agenda Item #07-0464 at the Board of Commissioners’ Meeting of June 6, 2007. On November 20, 2012, the Board of Commissioners approved the first Amendment (Agenda Item #12-1023) that extended the lease term through December 31, 2018.  Agenda Item #16-0566 which was approved on July 7, 2016, amended the name of the Lessor to reflect the sale of the Property to the current owner and the change in address assigned by the U.S. Postal Service. The Third Amendment to Master Lease Agreement for Facilities was approved by the Board of Commissioners on December 19, 2018 as Agenda Item # 18-0989.

Fiscal Impact / Funding Source

The required monthly rental payments will be paid from funding line 100-330-3305-1121.

During the period commencing January 1, 2022 and expiring the day before the Expansion Commencement Date, the monthly rent shall be Two Thousand Eight Hundred Sixty-Nine and 19/100 Dollars ($2,869.19) per month.
