GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. Also, O.C.G.A § 36-10-1 states that all official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Scope of Work: The Georgia Department of Transportation (GDOT) is planning improvements to Abbotts Bridge Road (SR 120) between Promise Parkway and Boles Road in Johns Creek. The project will include roadway widening and several intersection upgrades, including turn lanes, landscaped medians, and sidewalk enhancements. As part of this work, approximately 7,225 linear feet of 10inch water main and associated appurtenances will need to be relocated within the existing rightofway. Water service to customers will remain uninterrupted throughout the construction period.  GDOT intends to bid the roadway improvements in mid2026 and has requested execution of a Contract Item Agreement (CIA) with Fulton County to allow GDOT to include the water main relocation work in its bid package. Following award of the construction contract, Fulton County will reimburse GDOT for the actual water main relocation costs in accordance with the CIA. Fulton County staff will be on-site during the relocation to ensure all work meets County standards. The estimated cost for the relocation and installation of the impacted water mains is $2,426,610.00. Funding has been budgeted through the Water and Sewer Fund and is included in the 2026 - 2030 Capital Improvement Program.

 

Community Impact: Fulton County currently operates 10inch and 8inch water mains serving properties along Abbotts Bridge Road (SR 120). The planned road improvements will impact these existing water lines, which provide service to developments in the area and support the water distribution system supplying the City of Johns Creek.

 

Department Recommendation: The Department of Public Works believes that the most costeffective approach to completing the water main relocations is to allow the Georgia Department of Transportation (GDOT) to include the work in its roadway project bid. Therefore, Public Works recommends that Fulton County enter into a Contract Item Agreement (CIA).

 

Project Implications: The road improvements will impact the existing water mains due to grade modifications and roadway widening along Abbotts Bridge Road (SR 120), which require the relocation of water mains and the adjustment of valves to match the proposed roadway surface. These relocations are necessary to maintain uninterrupted water service in the area.

 

Community Issues/Concerns: During construction of the relocations, water service will be maintained, although temporary interruptions may be necessary during tieins to the existing and newly installed water mains.

 

Department Issues/Concerns: The Public Works Department is not aware of any issues or concerns with this proposed Contract Item Agreement (CIA).
