This Agenda Item is presented to the Board of Commissioners pursuant to O.C.G.A. § 36-9-2 which provides that the Board of Commissioners has control of all property belonging to the County and may, by order entered on its minutes, direct the disposal of any real property which may lawfully be disposed of, and pursuant to Fulton County Code § 1-117, which gives the Fulton County Board of Commissioners exclusive jurisdiction and control over directing and controlling all the property of the county, as they may deem expedient, according to law.

Summary & Background

 

Scope of Work: The Fulton County Department of Real Estate and Asset Management (DREAM) has received a request from the State Properties Commission (SPC), the space manager for all state entities, to extend the term of the Georgia Department of Human Services’ rental of County-owned property at 515 Fairburn Road Atlanta, Georgia. The Division of Family and Children Services provides numerous family and children support services from this centralized location.  DHS agrees to pay $49,591.00 monthly ($595,042 annually).

 

In accordance with Fulton County Policy, all contractual agreements in which Fulton County is a party of the agreement must be in writing and approved by the Fulton County Board of Commissioners.

 

Approval of the Board of Commissioners is being requested to extend the term of the Georgia Department of Human Services’ rental of 515 Fairburn Road, Atlanta, Georgia, from December 16, 2024 through December 31, 2025. 

 

Community Impact: Approval by the Board of Commissioners to execute this Reinstatement and Amendment of Rental Agreement with the Georgia Department of Human Services will not adversely impact the community and will allow the Division of Family and Children Services to continue to provide their services from the current location. 

 

Department Recommendation: The Department of Real Estate and Asset Management recommends approval of the Reinstatement and Amendment of Rental Agreement between Fulton County and Georgia Department of Human Services for the purpose of formalizing rental terms and extending occupancy.

 

Project Implications: The Reinstatement and Amendment of Rental Agreement between Fulton County and Georgia Department of Human Services is a revenue lease agreement for the County.
