GA CONST Art. 9, § 3, ¶ I provides that the County may contract for any period not exceeding 50 years with any other public agency, public corporation, or public authority for joint services, for the provision of services, or for the joint or separate use of facilities or equipment; but such contracts must deal with activities, services, or facilities that the contracting parties are authorized by law to undertake or provide. O.C.G.A § 36-10-1. All official contracts entered into by the County governing authority with other persons on behalf of the County shall be in writing and entered on its minutes.

Scope of Work: The Georgia Department of Transportation (GDOT) is currently planning on resurfacing Arnold Mill Road Houze Road (SR 140) from 0.08 miles south of the Cherokee County line to Houze Way in Milton, Alpharetta, and Roswell. As part of this resurfacing project, approximately 3 Sewer Manholes & 27- Water Valve Boxes will need to be adjusted to the proposed grade at the conclusion of the work. Water and sewer service will remain uninterrupted during the construction period. GDOT will be bidding the roadway resurfacing in mid-2021 and has requested the execution of a Memorandum of Understanding (MOU) between Fulton County and GDOT to allow the GDOT to bid the Sewer Manholes & Water Valve Box adjustments work as part of its project. Fulton County would then reimburse GDOT after the work has been completed and accepted by Fulton County. Fulton County staff will be on-site during the adjustments of Sewer Manholes & Water Valve Box to ensure that its construction is done to Fulton County standards. The estimated cost of the adjustment of the impacted Sewer Manholes & Water Valve Box are $ 59,600.00.00 and has been budgeted for as part of the water and sewer fund and included in the 2016-2025 Capital Improvement Program.
Community Impact: Currently, Fulton County has 10-inch and 12-inch water mains serving properties along Arnold Mill Road / Houze Road (SR140). The road improvements will affect the existing water and sewer lines that serve the developments in this area as well as the distribution system into the cities of Milton, Alpharetta, and Roswell.
Department Recommendation: The Department of Public Works believes that the most cost effective way to complete the sewer manhole and water valve box adjustments is by allowing GDOT to bid out the work as part of their roadway resurfacing project. The Department recommends approval of the MOU.
Project Implications: The road improvements impact the existing sewer manhole and water valve box due to modifications of existing grades with widening along Arnold Mill Road / Houze Road (SR140), which requires sewer manhole and water valves box to be adjusted to match the proposed roadway surface at the conclusion of the work.
Community Issues/Concerns: During construction of the adjustment of sewer manholes and water valve boxes, water & sewer services will remain uninterrupted, and service will not be impacted.
Department Issues/Concerns: The Public Works Department is not aware of any issues or concerns with this proposed MOU.
