Pursuant to the County’s Home Rule powers set forth in Article 9, Sec. 2, Par. 1(a) of the Georgia Constitution, “[t]he is governing authority of each county shall have legislation power to adopt clearly reasonable ordinances, resolutions, or regulations relating to its property, affairs, and local government for which no provision has been made by general law and which is not inconsistent with this Constitution or any local law applicable thereto” and Fulton County Code Sec. 1-117 confers upon the Board of Commissioners the exclusive jurisdiction and control over directing and controlling all the property of the county, as they may deem expedient, according to law.

Summary & Background: Resolution #23-0575, approved by the Board of Commissioners, included the City of Atlanta (the “City”) as the Licensee to the Right of Access License Agreement. MARTA has submitted a request to the Department of Real Estate and Asset Management (DREAM), to have the Fulton County Board of Commissioners amend the previously approved Right of Access License Agreement to include MARTA as the sole licensee. Onsite access to Fulton County-owned real property at 0 Mitchell Street SW, 0 Forsyth Street SW, and 0 Broad Street SW, Atlanta, Georgia, is required to construct a new bus stop platform at the Mitchell Street parking lot entrance. The planned improvements are being constructed to improve travel safety and overall mobility of the traveling public in the City of Atlanta.
In exchange for the Right of Access License Agreement, MARTA has agreed to compensate Fulton County $134,700.00, the amount determined via a feasibility study that it will cost Fulton County to relocate the primary entrance at the Mitchell Street Parking Lot from Mitchell Street to Forsyth Street and the projected costs to reconfigure the parking spaces of the Mitchell Street Parking Lot.
Community Impact: The proposed roadway improvements will improve public transportation within downtown Atlanta, create designated travel lanes for bicycles and buses, and a designated pickup and drop-off location for patrons of public transportation.
Department Recommendation: The Department of Real Estate and Asset Management recommends approval of a Right of Access License Agreement to provide MARTA access to the Fulton County-owned real property at 0 Mitchell Street SW; 0 Forsyth Street SW; and 0 Broad Street SW, Atlanta, Georgia to complete planned improvements to the roadway and public transit systems.
Project Implications: The planned construction of roadway improvements will reduce traffic congestion, improve safety for public travel, and provide alternate travel options for residents and visitors to the city of Atlanta.
