Pursuant to Fulton County Code Sec. 1-117, the Board of Commissioners has exclusive jurisdiction and control over directing and controlling all the county’s property as they may deem expedient, according to law. O.C.G.A. Sec. 36-9-3(a)(2)(A) authorizes the granting of rights of ways and easements from one local government to another local government without a competitive process.

Scope of Work: The City of South Fulton (the “City”) has submitted a request to the Department of Real Estate and Asset Management (“DREAM”) to acquire a right of way (740.52 square feet) and a temporary construction easement (8,948.97 square feet) to improve roadway conditions and travel safety near the intersection of Stonewall Tell Road and Union Road. The City's acquisition of the right of way and easement areas is necessary to ensure access for constructing planned roadway improvements and maintaining the roadway slopes along Stonewall Tell Road.
The City has agreed to compensate the County One Thousand Two Hundred and 00/00 Dollars ($1,200.00), based on a market value assessment of property values within the area, for the required property rights.
Community Impact: Approval of the request to transfer real property rights to the City of South Fulton will not adversely impact operations or the residents of the community in which the subject real property is located.
Department Recommendation: It is the recommendation of DREAM that the Fulton County Board of Commissioners convey the requested right of way and temporary construction easement areas to the City of South Fulton.
Project Implications: Planned roadway improvements will improve sight distance at the intersection of Union Road and Stonewall Tell Road.
