Board action is required pursuant to Fulton County Code, Appendix B, Zoning Resolution, Article XXXIV. - Development Regulations, 34.4.1 -- Land disturbance permit prerequisites. In addition, Board Action is required pursuant to Fulton County Code Section 1-117, the Board of Commissioners has exclusive jurisdiction and control in directing and controlling all the property of the county, as they may deem expedient, according to and to exercise such other powers as are granted by law, or are indispensable to their jurisdiction over County matters.

SUMMARY & BACKGROUND

Scope of Work: The proposed Elara at Bethany Project, a residential development, requires the installation of a water service line. Fulton County development regulations require that all new water line connections acknowledge Fulton County's ownership interests in the area(s) where a water service line connection is being made before recording the Final Plat. The easement area to be conveyed consists of 11,674.08 square feet and is located in Land Lot 972 of the 2nd District, 1st Section of Fulton County, Georgia.

Community Impact: The community will benefit from the extension of the County's water system and the addition of a residential development.
